1. Purpose
These terms and conditions govern all orders placed via the commanderie7.com website.
All orders imply unreserved acceptance of these terms and conditions.
2. Products
Products include fresh produce, fish, ready meals and other perishables.
Photos and descriptions are not contractual.
For items sold by variable weight, the final price is recalculated according to the exact weight at the time of preparation.
The amount indicated in the basket is for information purposes only.
3. Prices (incl. VAT / excl. VAT depending on customer type)
Individual customers (B2C)
- Prices are always inclusive of VAT.
Business customers (B2B)
- Prices shown are exclusive of VAT once the professional customer has logged in to their validated B2B account.
- Before connection, the default display on the site remains TVAC.
General rules
- The final amount will be recalculated on withdrawal according to the actual weight of the product.
- Prices displayed on the site may be modified at any time, but remain valid for the current order once confirmed. Barring errors on our part
4. Orders and confirmation
The customer selects a pick-up slot and validates the order.
Orders are confirmed only after a summary e-mail has been sent.
Commanderie7 may cancel an order in the event of an obvious error, stock problem or non-compliant customer account (e.g. B2B not validated).
5. Payment on collection (no online payment)
Commanderie7 does not offer online payment.
Individual customers (B2C)
- Payment is made only at the counter during pick-up.
- The final amount depends on the actual weight of the products.
Business customers (B2B)
- Payment on collection, unless otherwise agreed.
- Prices displayed online do not include VAT when a B2B account is correctly connected.
- Any delay in payment will result in a surcharge of 12% per annum by operation of law and without prior formal notice, plus a fixed and irreducible penalty of 15%, with a minimum of €75.00. In addition to this interest, the amount of our invoices may also be increased by €12.50 per letter sent. To be admissible, any dispute must be notified by registered mail within 8 working days of receipt of the disputed invoice. Only the courts of Verviers (Tribunal de Commerce or Justice de Paix de Verviers, at the choice of the plaintiff) have jurisdiction in the event of a dispute between the parties.
6. No right of withdrawal & non-refundability
According to article VI.53 of the Code of Economic Law,
No right of withdrawal and no refund is possible for perishable food products or those prepared to order.
A refund is only possible if an error attributable to Commanderie7 is proven (e.g. missing product).
All claims must be made on the day of collection.
7. Responsibilities
Commanderie7 is not responsible:
- poor preservation after removal,
- weight variations inherent in fresh produce,
- customer withdrawal delays,
- problems due to incorrect use of the account (e.g. B2B not connected = TVAC display).
- Orders not collected on the same day cannot be reimbursed, as the products are fresh and specially prepared.
9. Personal data (RGPD)
Data is only used to process orders and is never resold.
The customer can request the modification or deletion of his data via the contact form.
10. Applicable law
These GTC are governed by Belgian law.
Any dispute shall be submitted to the competent courts after an amicable solution has been sought.
